Case Study
A Chinese exporter exported 20, 000 boxes of goods, contracting to ship the goods in each lot during May to August,
5,000 boxes each month, payment by confirmed irrevocable letter of credit. The customer duly issued the credit on which the amount is in conformity with the contract, but the shipping clauses indicated “the latest date of shipment is 31st, August, by partial shipment.” The exporter dispatched 5, 000 boxes in May, 6, 000 boxes in June, 7, 000 boxes in July and 2, 000 boxes in August. The importer raised an objection to this. Are the exporter right to make shipment in this way? Why?
Analysis
In order to get payment in due time, the exporter is supposed to do in this way. As the letter of credit is independent of the contract, and once the relating documents presented are in conformity with the credit, the exporter can get payment. In the case, the credit only indicated the latest date of shipment and partial shipment allowed, without specific stipulation about the quantity of each lot. So the exporter is right. But in order to avoid the future disputes aroused, the exporter should make partial shipment in four equal lots, which is corresponding to both the credit and contract.
