The exported 50 M/T rice was insured against All Risks and War Risk on a “warehouse to warehouse” basis. The rice was lost during the transportation from the exporter’s warehouse to the quay at the port of shipment. If the contract was concluded on a CIF basis, would the seller get the compensation from the insurance company? What about under CFR or FOB? Why?
Whether the importer or the exporter shall take out insurance is decided by trade terms and sales contract clauses. In case the insured goods suffered losses within the scope of insurance cover, the party who has insurable interests can lodge a claim for indemnity from the insurer on the strength of the insurance documents.
